What is the E-2 Treaty Investor Visa?

It’s a nonimmigrant visa that allows citizens of qualifying treaty countries to live and work in the U.S. based on a “substantial” investment in a bona fide U.S. business.

Is there a minimum investment amount?

No fixed dollar minimum exists in the law. The investment must be large enough to fund the type of business you’re pursuing and show financial commitment. Capitalization expectations differ by industry.

Can I buy a franchise or invest in an existing business?

Yes. You can start a new company, purchase an existing one, or invest in a franchise—so long as the investment is active and at risk, and the business is more than marginal.

Can my spouse and kids come with me?

Yes. Your spouse and unmarried children under 21 are eligible for E-2 dependent status. Spouses can apply for work authorization in the U.S.

How long does the E-2 last? Can it be renewed?

E-2 status is typically granted in up to two-year increments (visa validity periods vary by treaty country). You can renew indefinitely as long as the business continues to meet E-2 requirements.

What if I’m already in the U.S.?

In many cases, you can file a change of status via Form I-129. If applying from abroad, you’ll go through a U.S. embassy or consulate.

Does an E-2 lead to a green card?
